§ 1 1. Scope
These terms and conditions apply to hotel accommodation contracts and all services and deliveries provided by the hotel, Sauerländer Monteurwohnungen, Mario Grabau, Wemensiepen 33, 58809 Neuenrade. Deviating provisions shall not apply unless expressly acknowledged in writing by the hotel.
§ 2 2. Contract Formation
The contract is concluded upon acceptance of the guest's request by the hotel. The hotel may confirm the room booking in writing. If a third party has booked on behalf of the guest, both are jointly and severally liable for all obligations under the accommodation contract.
§ 3 3. Booking / Cancellation / No-Show
3.1 The accommodation contract is concluded once the room has been ordered and confirmed or made available. The invoice together with the booking confirmation constitutes a binding contract for the agreed period. Booking can be made in writing, verbally, by telephone or electronically.
3.2 Conclusion of the accommodation contract obliges both parties to fulfil the contract, regardless of its duration.
3.3 The landlord is obliged to pay compensation to the guest if the room is not made available.
3.4 3.4 Cancellation Fees
You may withdraw from the contract and cancel your rental agreement. The reason for cancellation is irrelevant. The following cancellation fees apply:

3.5 In case of non-arrival at the start of the rental period without notification to the landlord, the claim to the entire reservation expires.
3.6 The landlord is obliged in good faith to re-let unused rooms where possible. Until re-letting, the guest is liable to pay the contractually agreed amount.
3.7 Arrival and departure day count as one day.
3.8 The exclusive place of jurisdiction is the place of business.
3.9 The invoice date is the service date. Payment for the booked period is always due in advance, at the latest upon arrival. In case of non-payment, the hotel may cancel the contract.
§ 4 4. Hotel Cancellation Rights
4.1 If the customer has a free cancellation right within a certain period, the hotel may also cancel during this period if other customers request the same rooms and the customer does not waive their right to cancel upon request.
4.2 If an agreed advance payment or security deposit is not made after a reasonable grace period, the hotel is entitled to cancel.
4.3 The hotel may also cancel for good cause, in particular in cases of force majeure, false information at booking, risk to operations or an illegal purpose of stay.
4.4 A justified cancellation by the hotel does not give rise to any claim for damages by the customer.
§ 5 5. Room Provision, Handover and Return
5.1 The customer does not acquire a right to specific rooms unless expressly agreed.
5.2 Booked rooms are available from 18:00 on the agreed arrival date. There is no entitlement to earlier availability.
5.3 On the departure date, rooms must be vacated by 10:00 at the latest. Late check-out fees: up to 14:00 – 50% of the full list price; from 14:00 – 90%.
§ 6 6. Liability
We accept no liability for valuables or personal injury. Guests are responsible for their own valuables. It is assumed that guests handle the apartment inventory with care. If the contracting party is a company, it is liable for its employees during the stay. Damage caused by guests will be invoiced in full. Damage and defects must be reported to the hotel immediately upon discovery.
§ 7 7. Cleaning
Final cleaning is included in all bookings as contractually agreed. Intermediate cleaning arrangements will be specified in the booking confirmation. Each unit has its own cleaning utensils for independent cleaning by guests. In case of excessive dirt, we reserve the right to charge an additional cleaning fee of €150.00. Waste disposal is not included in the cleaning fee and is charged separately. Rooms must be left broom-clean, rubbish must be disposed of, and kitchen utensils (dishes, cutlery, glasses, pots, pans) must be washed and stored as found on arrival. We reserve the right to charge a flat fee of €25.00 for necessary waste disposal and €30.00 for kitchen utensil cleaning.
§ 8 8. Smoking
Smoking is only permitted under agreed conditions and in designated areas. Violations of the smoking ban will be charged at €200.00 per room as a special cleaning fee. In cases of serious violations, the contract may be terminated without notice.
§ 9 9. Deposit / Key Loss / Handover
Upon arrival, a flat-rate deposit of €250.00 per booked apartment or room is required. Key loss and necessary lock replacement will be charged at €100.00. The deposit covers: excessive cleaning costs, waste disposal, kitchen cleaning per clause 7, key loss and other damage. Additional damage exceeding the deposit amount will be invoiced separately. Unless otherwise expressly agreed, the deposit is paid in cash upon arrival.
§ 10 10. Receiving Visitors
Guests must consult the landlord before receiving visitors. Without prior consultation, access by non-registered persons is prohibited. Additional guests may only be accommodated in exceptional cases and with the hotel's consent. Events with unregistered persons are prohibited.
§ 11 11. Quiet Hours / Outdoor Areas
Quiet hours are set out in the house rules. Violations may result in a warning and, on repeated occurrences, termination of the contract. Outdoor areas are limited to balconies, terraces and areas specified in the booking. Barbecuing and playing music outdoors is only permitted in agreement with the hotel in designated areas. In case of disturbance to other guests or neighbours, we reserve the right to issue expulsion notices and to terminate the contract without notice.
§ 12 12. Pets
Pets are only permitted with prior consultation with the landlord. Without prior consultation, pets are strictly prohibited. We reserve the right to decide on a case-by-case basis whether pets are allowed.
§ 13 13. Waste Disposal
The tenant is personally responsible for waste disposal as described in the house rules and by the landlord's instructions. Incorrect waste separation or failure to dispose of waste properly is subject to the provisions of clause 7. We reserve the right to cancel the contract for serious violations and to charge a special cleaning fee of €150.00.

§ 15 15. Final Provisions
15.1 Amendments and additions to the contract or these T&Cs must be made in text form. Unilateral changes by the customer are invalid. These T&Cs are accepted upon booking/arrival and are valid without the guest's signature.
15.2 Place of fulfilment, payment and exclusive jurisdiction is 58809 Neuenrade.
15.3 German law applies. The application of UN sales law and conflict of laws is excluded. Should individual provisions be or become invalid, the validity of the remaining provisions shall not be affected.
